As most of you likely have heard, the Occupational Safety and Health Administration (OSHA) has suspended enforcement of its Emergency Temporary Standard (ETS) on vaccine mandates for large private businesses after a federal appeals court blocked the measure
OSHA posted a message regarding the ETS on its website on November 12: https://www.osha.gov/coronavirus/ets2
“The court ordered that OSHA 'take no steps to implement or enforce' the ETS [Emergency Temporary Standard] 'until further court order.' While OSHA remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation,” OSHA said.
APCA is proud to inform you of today's release of a new, comprehensive study of the nation's 811 system, which found that failures in the system are costing the U.S. some $61 billion a year in waste and excess costs and creating unnecessary hazards for public safety.
The study, unprecedented in scope and scale in the damage prevention space, was conducted by Continuum Capital for the Infrastructure Protection Coalition (IPC), a coalition of industry groups who represent regular users and stakeholders in the 811 system and want to see it run safely and efficiently.

As Congress nears an agreement on budget reconciliation legislation, APCA President Taylor Dacus sent a letter to congressional leaders on October 28 that offers our industry’s perspective on the consideration of a methane emission fee and of several harmful labor policies.
"APCA strongly objects to including a methane emissions fee/tax in reconciliation legislation," Dacus stated. "This proposal could lead to double taxation of critical members of the energy supply chain that are at the forefront of reducing greenhouse gas emissions, including methane."

The American Pipeline Contractors Association (APCA) expressed strong disappointment in President Biden’s revocation of the cross-border permit between the U.S. and Canada for the Keystone XL pipeline as part of his “Day 1” executive actions. The pipeline was being built to carry more than 800,000 barrels of oil a day from Alberta to the Texas Gulf Coast, passing through Montana, South Dakota, Nebraska, Kansas, and Oklahoma. The president’s move comes at a time when 300 miles of pipeline included in the 1,200-mile project have already been constructed and when the energy industry cannot afford to lose sacred jobs in midst of a global pandemic.
APCA is saddened to report the passing of Mark Beard, founder of Beard Oil Distributing and a friend and valued colleague to many in the association and throughout the pipeline industry.
Mr. Beard, 72, of Mt. Pleasant, Mich., passed away on January 31 at his home. He was born on October 27, 1948, in Mt. Pleasant, son of the late Leo M. and Glenna L. (Shuttleworth) Beard. A 1966 graduate of Mt. Pleasant High School, he attended Central Michigan University and Northwood College.
From a young age, Mr. Beard worked alongside his father, Leo, at Hub Oil and Beard Oil and Supply. In 1984, he established M & L Petroleum Inc., where he was awarded the fastest-growing business in the state of Michigan. In 2005, Mr. Beard established Beard Oil Distributing among other companies, including his most recent venture, Beard Motorsports. From a young age he loved race cars. He started from building go-karts to realizing his goal of racing late models and Busch Grand Nationals at Daytona. In 2016, he established his own NASCAR Cup Team, running the #75 car, then the #62.
WASHINGTON, DC – The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) reminds employers that the agency will begin collecting calendar year 2020 Form 300A data on Jan. 2, 2021. Employers must submit the form electronically by March 2, 2021.
